For decades, close family members have been able to claim for psychiatric illness caused by witnessing the death or serious injury of their loved ones, whether it be on the scene of the accident, hospital or mortuary. The jury has been out on the recoverability of these claims when the “qualifying accident” has been the result of admitted clinical negligence. The Supreme Court has just ruled this out as a basis for compensation.
